could be so many things. but oil in the bottom of the engine not caught by filter suggests to me maybe the big end bearings. As for keeping or getting rid, just do the maths. Its an 08 s40, that's not worth much and will be getting little mileage for the coming months. no one wll be buying and if you are in the uk you will be walking a fine line with the law keeping this issue secret on sale.

If it were me, I would run it til it goes pop and get my moneys worth. will be most cost effective in long run.
