I guess the question is do you want to move forward or waste any more of your life looking backwards?

I'd get the car recovered a.s.a.p. and over to someone else more competent and honest.

FYI becuase D5 engines, especially the 163 E3 units, are so reliable they are as cheap as chips second hand. If cylinder head work is required it's usually cheaper these days to drop in another lump unless yours is particularly low mileage. An engine, timing belt kit, labour be cheaper than then head work, lots more labour and a head gasket kit. The D5 is relatively easy to lift out of the XC90 as there's loads of room.
