They are a private parking company so no powers to issue a fine or penallty. As said before they can only take you to court for breach of contract - unless their sign mentions fine or penalty which means it would be thrown out before it got started.

Of course they have no right to ask who was driving the vehicle at the time of the parking matter took place so they cannot start court proceedings if they do not have the name.

On the plus side you have won a free supply of loo role!

They are looking for people who they think they can threaten. Don't take the bait. They have NO right to send you anything.

The fact that this dodgy firm is based where it is says it all to me. In these times all the scams in the book are coming out.

I got sent a parking notice for spending more than 3 hours at a service station on the M1 at a Mazda meet, and they kept sending me letters and in the end, they just gave up. The only ones you should pay are the ones from Councils and the Police.

If you have any queries, then go to MoneySavingExpert.com as they have a forum which have loads of people asking about things like that.

I nearly fell off my chair seeing Middx in the "Northampton" (forwarding) address. People use Northampton because it is the most used County court with regard to the small claims, usually by Barclaycard.
This is a serious paux pas, confusing the forwarding address with the operating address of Newlyn being 180-188, Northolt Rd, South Harrow
Harrow, Middlesex, or 584 2nd Floor,High Rd,Wembley,Middlesex,HA0 2DB.




Oh, and where does the mail get redirected to from Northampton, Liverpool and god knows where-else.

Northampton is the court that deals with all the moneyclaim online small claim court actions. As a defendant you can request that it is transferred to a court local to you.

As for this particular circumstance:

This 'scam' relies on contract law. e.g. you have overstayed the allotted time and breached the implied contract you undertook by parking in the car park in the first place.

There's no reason to pay this, mainly because as it concerns a breach of contract, the only claim they can legitimately make is for loss incurred as a direct result of that breach. If the car park was free to park in, then they've lost £0, so even if they did go to court, there's nothing for them to claim.

Also, they pay DVLA £2 to get the registered keepers details. However there is no obligation for the registered keeper to name the driver, and it is only the driver who they could chase for payment as it is the driver who entered into the contract by parking there.

These outfits make their money by sending officious looking letters which are meant to look like a PCN but are actually an invoice.

Do not enter into any correspondence with them, just file away and wait for the next letter. You'll get 4 or 5 before they get bored and pester someone else.

They'll threaten baliffs, and bad credit history, but unless, they actually go to court, convince the magistrate that they have actually incurred a loss, that they have identified the driver, and won, and then you haven't paid them following a court order, none of these things will happen.

The link between Gary Wayne and Gary and Wayne Southall is too interesting to pass off.

As has been proven before a "Static" address is no proof of residence.

Im sure Gary Wayne' removal as a director of Ovda Trading had no involvement in the case of Wayne Southall despite several (undisclosed im afraid) links http://www.thelawpages.com/court-cas...all-5883-1.law
