I'd want a cast iron "Sold as seen and tested" based caveat before I'd entertain it. Then again, such is the way the world works even that doesn't seem to protect sellers these days and all this "fit for purpose" rubbish.
Private car sales are no longer all buyer beware or ‘sold as seen’, the buyer can come back if there are a limited set of problems. There is also a scam to beware of.

There have been several changes to legislation, the RTA 1988 (1991), Consumer Rights Act 2015, etc that has reduced the effectiveness of the phrase ‘sold as seen’. As you say you can’t make false claims but also
  • The seller must have the right to sell – if they do not then the owner can claim it back and you must chase the seller to get your money back.
  • The car must match the description and photograph used – Even if the buyer comes and collects the car, and then after they take it away complains that the description is wrong then the buyer could return the car and get their money back minus an amount for fair wear and tear.
  • You cannot sell a care that is unroadworthy and if it is not then you just need to state that in the description.

The scam is that a car is brought and the buyer then claims that it is unroadworthy under section 75 of the RTA 1988 (1991) and that they will complain to the police or take the seller to Small Claims Court. The police are unlikely to do anything unless the seller has a history of selling dodgy cars but the Small Claims Court is another matter. It is simple to raise a claim in the hope that the seller returns a large sum of money to the buyer who then drops the claim. If a buyer does this then ask the buyer to MOT the car and send a copy report which can then be checked with the MOT station. If it is genuine then the seller is responsible to repair or refund. If it is not and they persist then get a solicitor involved.

I didn't say they were all buyer beware or sold as seen and I even listed some exceptions, some of which you've actually repeated.

Agree with Dave, a buyer who can’t afford a secondhand car outright to me (and in my experience) is far more likely to come back complaining, trying to claim some money back etc. down the line if something goes wrong. In that respect, though it’s their business to finance the purchase how they please, this sort of thing sets alarm bells ringing for me so I’d avoid.

The world is now unfortunately full of people who have no actual money but want everything (they can’t afford) immediately for some reason.

DO NOT accept paypal for a car, its too easy for the buyer to claim the money back. Can you PROVE that you posted it ? no. Can you afford to Sue paypal in lichtenstein or wherever the office claims to be >?

I will only accept cash or a bank transfer when selling something of value.

paypals fine for the trivial tat people buy and sell via evilbuy, thats about it.

No it isn't, so long as it is a gift payment (friends and family) only.
That's as good as cash and beyond any refund policy of PayPal and there's no fees to receiving the money.

Unless they dispute the charge with the credit card company which may happen. Far safer with a bank transfer, if they can do paypal no reason why they can't do a bank transfer.

Yes there is.
You have to have Internet banking enabled to do a transfer, PayPal comes off the registered card.

For personal reasons I do not have any of my accounts registered for Internet or phone banking, I can however write you a cheque or deliver cash.

Personally, I don't even phone a car advertised as 'sold as seen' as alarm bells immediately ring in my head. Irrational? Perhaps, but I buy with my eyes and judge the owner, length of ownership, knowledge of car/make etc?

I kind of like the sold as seen ones.
They do invariably have an issue which the owner thinks is an expensive fix but they're almost always very cheap to fix.
The ones that aren't cheap to fix, I'll leave for some other mug.
