Default Mistake made on new car order. Poor options given...

We placed an order for a new V40 on finance some months back specifying that we needed a specific delivery date due to a current lease car ending. We were told the car was delivered about 3 weeks ago to an offsite compound.

Dealer rang me today saying he's just been to see the car and it's not the spec we ordered. It has leather where we didn't order it. He's given us two options.

Keep this car and pay £12/month more than we signed up to.

Or

wait for a new car to be ordered.

There's no way we should be paying extra for something we don't want and isn't our fault. When I said this he said there was nothing they could do to absorb the cost of the mistake. I dont understand this as if they try and sell the car on they won't get list price for it now.

Also given our lease car ends in one month we are now stuck as the lead time on another new car is in excess of this. So if we wait for a new order we will likely need to rent a car for a month or so.

Can anyone suggest any options open to us? And legally who should foot any out of pocket expenses as a result. Very annoyed by this.

Whoever cocked it up should do the honourable thing and lend you a car until the new one arrives, or let you keep the one you have and change the seats if they feel its cost effective.

Not sure of your rights legally speaking..

you do not need to and shouldn't be asked to pay for something you didn't order/specify.

the dealer should honour the original contract/deal or compensate you for any additional costs which could be incurred due to this mistake.

In 2009 I placed a factory order for a fully-optioned V50 DRIVe. It arrived without the active Bi-Xenons. The dealer admitted the mistake and took the car back off me within the week BUT lent me a V40 until my correctly ordered V50 arrived some two months later. (My old Passat had been traded-in on the scrappage scheme so having this back was not an option.)
This is what you should insist on.
It might just be cheaper for him to waive the £12 per month !

Tell them you want a new car to the spec you ordered and a loan car until it arrives. Or you will cancel order and take them to small claims court for breach of contract - their obligation to provide car to spec ordered by date required....

Always said politely and firmly - in person if you can.

15 years ago I bought a new Discovery.

on collecting the car the salesman was showing us the knobs and controls when he realised it had a winter pack fitted. ( heated screen, mirrors, etc )

an extra costing about £1500.

he didn't even contemplate charging for it and I was delighted !!

You need to write to them giving them the date you want your car by and making time of the essence (use that very phrase).

I'm missing something here. Anytime I have ordered a new car, it has been delivered either to my home, or to the franchised dealer with whom I placed the order.

Even if the car were delivered to some interim compound, why would the dealer spend his time and money "going to see it", when he could just wait for the delivery truck?
