Precisely, in the pizza example you quote you have a contract with the company as they offered a service which you accepted when you purchased the goods. In their offer they states that they would deliver by 20:00, and then they failed they were in material breach. Similarly in the letter you quote there was a contract to deliver by the specific date which the contractor failed meet hence he failed his obligation.

I relation to the car you will probably find that there is no fixed or committed or date of delivery, perhaps an indicated date but not a firm date. You would also need to check the Ts&Cs to see what relief they may have in the case of failure to deliver to specification or on the date the purchased expected.

It is always best to resolve issues such as this face to face in a friendly discussion, attempts to use legal wording (quasi or otherwise) generally end in frustration, failure and additional expense which always detracts from the perceived value.

So they did the sums and decided it was cheaper for them to loan you a car and re-order the one you wanted. At £12 per month, I'm not sure they can use a calculator !

Bear in mind, that £12 is retail price, the actual cost to them would have been even less than that.

It does seem they're cutting off their nose to spite their face, so for the sake of £12 per month (retail) they've messed a customer around and landed themselves with a car with a spec almost as chosen by Freypal which they will now end up discounting off of their forecourt, and the cost of the loan car for however long it takes. It would seem to make more sense to have phoned Freypal in the first instance and said something like 'We've checked your new car and noticed it has a leather interior that you didn't ask for. Would you accept it with leather? No extra charge to yourself of course.', that would allow for Freypal to say he hates leather so get it changed, or he would have accepted it then come on here all smug that he'd got leather for nothing and told us what lovely chaps they were at the dealership.

I suppose at the end of the day Freypal will get exactly the car he ordered and will have a loan car in the mean time, but it could so easily have been a much happier story.
