Default Options/Advice for terminating a lease

Anyone know if there are grounds for a car having repeat problems to terminate a lease and simply return the car or demand a replacement?

I'm well outside the 12 months typical period for rejecting a car but wondering if ongoing issues can be grounds?

Lease is thru volvo car leasing

Anyone?

I don't know how it would apply to a lease but the Consumer Rights Act 2015 doesn't specify a time limit for ultimately rejecting goods (although one's options are different for the first month).

As time passes it becomes more difficult to reject something but there are several parameters that can be taken into account such as the value of the item, its anticipated lifetime and the severity of the fault(s).

There is probably an official formula but expect that to apply. What I mean is that you are unlikely to get anything like your money back at this stage. I’d hazard a guess that the best you could hope for is to stop payments and not have to pay a penalty.

Check the terms and conditions of your particular lease and see whether the Consumer Credit Act (or whatever it is called) applies and then refer to that act.

The lease Ts and Cs may also contain provisions for the issue you are having such as a dispute resolution.

yeah, thanks. Going to go talk to the supplying dealer before we have to go down any stressful routes.

I think we are pretty realistic. I'm going to automatically assume Volvo car leasing will tell us to suck it so we avoid any false expectations there. Maybe we'll get lucky, who knows but assuming we'll have to take it higher. Either someone in a dispute resolution would agree the level of issues we've had is worthy of upholding our complaint or they won't.

I think we'd go for a replacement rather than trying to get compensation/money back. I'd be prepared to sign another lease in theory on another xc90 if they made it a simple thing to do.

I guess I'm about to learn about consumer rights for PCH...

Sorry that you have had these issues with your car. My understanding is that the car is owned by the leasing company so you will probably end working with them on a resolution rather than the supplying dealer.

As mentioned earlier have a look at the lease Terms and Conditions - no doubt there is a section on disputes which should help with the process.
