1 - Use of an indicator does not confer any right to move into the path of another vehicle.
2 - HGVs are not allowed in lane 3, so it's fair to say the traffic copper was entitled to his reasonable expectation that the lorry would not move into it. 3 - Plod car had lights on so there's hardly an excuse for moving over when it wasn't safe to do so. I see in the youtube comments, people saying the motorway went down to 2 lanes so the lorry was allowed to be in the far right hand lane, but that's not correct, because at the time of the impact, there were 3 lanes, and the lorry moved into the 3rd one, which isn't allowed. I appreciate the police car was approaching the lorry quite fast, however, considering the accident wouldn't have happened if the lorry hadn't gone into lane 3, I would have said the lorry driver to blame in that one. Anyone know if he was prosecuted, and if so, what was the outcome ?

Truck driver sounded as thick as a workhouse butty. He didn't have an answer, because he knew he shouldn't have been in lane 3. That said, I think the cop was a typical bull sh!te talking Nob Head prick as well.

The collision happened on a slight bend. Looking at the camera footage from the car you can't see the HGVs mirrors until it's to late. I honestly don't think the truck driver saw him. There are faults on both sides, truck should not be in lane 3 but the police car should have turned on full lights and sirens on his approach to the HGV to warn of his presence. Really a police driver should also expect the unexpected.

Contributory negligence on both sides here.
120+mph with No Blues and Twos? Really? Is that acceptable? I also doubt whether he had flashing headlamps on to be honest. Left hand sweep - truck driver had no chance of seeing cop car in right hand wing mirror, not sure about left hand one. Even if he'd seen it, it would have been miles back to begin with so wouldn't be able to identify it as a police car at speed given the lack of blue lights and probably wouldn't have been able to judge the speed of it. Having said that, he should have been more aware of his surroundings. I understand what he was saying about turning right so needed to move across but there were signs saying the carriageway goes from three to two so no need for him to pull across. Cop should have had better anticipation, especially since he didn't have blues and twos going. Well, he should have anticipated the actions of the truck driver AND had his blues and twos going. He's an advanced driver. Expect the unexpected. He's as much at fault, if not more, than the truck driver IMHO. Then the recollected clip about his blow out. He says he was doing 120mph and the tyre blew out and he lost it and spun. "I decided that going along the hard shoulder at that speed with a blown tyre would have been dangerous so tried my npbest to control it". What? Seriously. Mate, your tyre blew at high speed, you couldn't control the vehicle (let's face it, who could?), it spun, it crashed, you survived. The only thing going through your mind was oh ****, don't retrospectively try and make out that you considered different options. You did well not to die, let's just leave it at that. The man has a dangerous attitude. We don't need people like that policing our roads. |

Quite old footage this, remember watching it on TV some years ago now. Fault was on both sides, sure, the HGV shouldn't have been in lane 3 but also he wasn't expecting a car to be tramping down the outside lane at 125 mph. The cop car should've had blues & twos on travelling at that speed also. And agree about the copper's attitude, quite a bit of bravado going on there.

I know that section of road and its perfectly legal for hgv's to use land 3 as at that point it is no longer a motorway as its approaching M18 rounderbout and outside two lane split off to turn right and go into services and left hand splits off and drops onto m18 other way,
Copper doing 45mph over national speed limit should have had blues and twos on and been fully aware of what a drive unfamiliar with the road might do

To quote from the video at 5:05 'They drive for a living, they should have something more about them' ... 'he should have been able to anticipate my actions' it's a shame that Billy big wheels the traffic cop doesn't seem to think his own words apply to himself. If you're going to drive down the motorway at 125mph+ then the responsibility is on you to use superior observation and anticipation skills, not expect to pop out of a trucks blind spot and expect him just get out of the way.
And having been involved in the accident he was totally unprofessional starting to berate the truck driver, using his authority as a police officer to try to apportion blame. Generally I am supportive of police officers, even the traffic cops 'niggling' over things like seat belts, mobile phones and doing 5mph over the limit, but I'm afraid not in this case.
