Default V70 Lights Problem - Day/Night Mode

I have got a V70 T5 estate that is Dec06 and is an ex policecar.
Since I have had it I have had a lights problem.
Dash lights keep changing between brights and dark lights (day and night mode i assume)
At night it also mean high beam changes back to low beam all the time
Is this a switch unit problem or is is a sensor problem
Could a sensor have been painted over when painted black (it was white)
when you remove the sitch unit it stabilises with i think dip lights on
any ideas or troubleshooting appreciated

Thanks I had read one of those this morning but mine does it just sitting without moving in constant light conditions and flips back and fore between one mode and the other. Will try messing about with the sensor and report back but on mine it is just not the dash lights, it keeps switching high beam off when driving too which is really annoying and leans you have to hold high beam on manually by pulling the indicator stalk back ?? Wonder if ot has something to do with the tinted windows ?

Regarding the main beam it helps to have the hedlamps turned on at the switch ..
