ETM Issues Discuss issues regarding the problems with ETMs fitted to Volvo cars.

Information
  • VOC Members: There is no login facility using your VOC membership number or the details from page 3 of the club magazine. You need to register in the normal way
  • AOL Customers: Make sure you check the 'Remember me' check box otherwise the AOL system may log you out during the session. This is a known issue with AOL.
  • AOL, Yahoo and Plus.net users. Forum owners such as us are finding that AOL, Yahoo and Plus.net are blocking a lot of email generated from forums. This may mean your registration activation and other emails will not get to you, or they may appear in your spam mailbox

My advise would be to get the exchange ETM and then take dealer AND Volvo UK to your local CC to get your money back...
The legal details have been posted in this section of the forum already as someone has successfully sued their dealer and got their money back.
Adding Volvo UK to the equasion will force Volvo UK into facing up to this issue.
Much in the same way Banks are currently facing up to the Bank Charges Debacle..

Thanks for the advise Des. I have just got back from Rybrooks Volvo today. No warning light coming up, nothing showing up on Diagnostic. I did however nearly rear end a nice 5 series Beemer as i pulled away from a junction, the car hesitated and then surged forward with 260bhp behind it. The worrying part being my 12 month old daughter was in the back. I expressed my concern for her and my wifes safety when i dropped it off, to be met with a somewhat apethetical responce. I was later advised that a replacement ETM would be required at a total cost to me of £375.00 fitted. Volvo having fronted 20% with it having full service history. I am due to collect on Monday where i will be asking to see the service manager. I have already voiced my opinion to them on the American recall, not fit for use, safety and the fact that another has claimed (and won) issues, threateded them with the small claim court to be met with a responce of "Well thats a matter between you and Volvo" WTF ever happened to customer relations
Any chance of a link to the legal details thread?

Yes indeed.. Volvo have not done themselves any good with the way they have handled this issue.
And even in the US it was only through force and a breech of other regulation that they were finally pushed into doing something..
Not good at all..

Thanks very much for the link I am left a touched confused now though. I bought my car from a Volvo "SPECIALIST" not the Volvo Dealer whom is replacing the ETM for me. I have no problem with whom i purchased the car, he has been very advising on this matter, and has gone out of his way to accomodate us when servising is due. So i am left wondering whom i take court proseedings out against? Volvo UK, Rybrooks (Dealer undertaking repair) or The "Volvo Specialist" I purchased the car from. Surely we could all be liable in this case, if anything goes wrong with a car we sell privatly?????????

Who are you giving your money to?

There lies your answer.

Certainly, I know that your delaer doing the work has not caused the issue, nor are responsible for the situation. That is ultimately down to the importer - which is Volvo UK...

Hence my suggestion that anyone taking court action, while only needing to take the dealer to court, should also include Volvo UK.
2 reasons:
1) They are the official importer of the vehicle and as such are responsible to the state of the vehicle and the quality of components and materials therein.
2) This will push them into the position, similar to the banks, where if they lose the case then there is a, seemingly, lower court precident in the "fitness for purpose" of this ETM unit.

Remember, the people who have lost their cases against banks (notably the lloydstsb ones) did not have sufficient proof or a well prepaired case to present - hence they lost. Not because the bank was right or the charges were fair and reasonable!
So don't be unprepaired when following this route.

Thanks again Des. I will lodge an official complaint against the dealer if i am not satisfied with the outcome on Monday. I will then contact my trade union with regard to legal aid to persuit this matter. With a bit of luck since one person has been successfull, i will get granted a solicitor and take them to CC and rip them to pieces. I certainly am not letting this lie now, especially since finding out a member here has been charged considerably less than me for the same job, with the same Volvo 20% contribution. Many thanks to all here for their help on this matter!!!
