ACC gives you an immediate warning if traffic slowing ahead exceeds the braking capability of the system and you should take over, so I think Volvo would tell you to do one.

I think if you hit the back of another car while on adaptive cruise you'd feel pretty stupid, as I find that using it gives me the capacity to watch traffic much further down the road for problems.

Wonder no more, even if the manufacturer were proved liable in a separate case it will never exonerate the driver, even the worst of the judiciary are unlikely to consider that it was not your fault.

I daresay its covered in the manual with a million and one caveats.

The failure or not of the system or any deficiency in its design would be a lengthy and very technical case that basically will come down to what expert witness they like the best!

You would only get away with it if you could prove you were in some way prevented from manual intervention to stop.

People have tried to claim no responsibility with the full autopilot TESLA without success, so I don't see how you could win with only ACC.

Volvo have said they will accept full responsibility for accidents caused by their new autonomous cars when they start driving on roads.

Until we have full autonomous cars it's completely the drivers responsibility to drive safely.
