The failure or not of the system or any deficiency in its design would be a lengthy and very technical case that basically will come down to what expert witness they like the best! You would only get away with it if you could prove you were in some way prevented from manual intervention to stop.

People have tried to claim no responsibility with the full autopilot TESLA without success, so I don't see how you could win with only ACC.

Volvo have said they will accept full responsibility for accidents caused by their new autonomous cars when they start driving on roads.
Until we have full autonomous cars it's completely the drivers responsibility to drive safely.
