Default Potential XC90 Owner

After much trawling through the usual places for the right spec facelift 163 D5 of either V70 or XC70 for the girlfriend, I just couldn't find one that met the criteria. I did find an 04 XC90 SE D5, 163bhp, M66, 165k, with sat nav in the spec that we wanted on ebay and I managed to win the auction at the second time of asking, so I'm off to view it tomorrow (Under the traders T&Cs as long as the winner views it then they will just relist if you don't buy it).

Lets just hope when I inspect it I don't find a long list of issues. Fully prepared for the angle gear to be knackered, and I'll be changing the belts as a matter of course along with a full service, but it will be very interesting to see what else will need doing to it.

If that was the one listed by CarsWithNoReserve, I had a think about that, it looked pretty good and was in a good colour. You can never tell until you meet them in the flesh though... but their feedback is excellent.

If it is them I have delt with them and they are very fair, you can take the car and test it for as long as you like on the day. But there probably will be something wrong the car, if you find it and you think you can fix it tell them and they might offer a discount. But read the small print once you've bought it the deal is done. I went to look at a xc90 they had it was a beautiful car but the gear box acting up and one off the font discs pads was metal to metal I would have been happy to fix that but not the gear box. Hi, yes thats them, its the dark green one that I won. Im on the way down on the train, lugging around tools, gloves, inspection light and of course vida/dice, plus I have Mr Williams only a phone call away to help me decide whether the repair costs are worth it. If I do buy it, ill be taking it straight up to Leicester for him to go over it as well to make sure I haven't missed anything.

As its a manual see if you can check if the clutch and or the slave cylinder has been changed. The slave on ours started leaking at 172k
Oh and dark green is a great colour in the flesh as it appears darker or lighter depending on the viewing angle.

You could be right. But my understanding is that they trade the cars sold as seen.

I think also they add Spares or Repair to the reciept. Either way, its just like buying privately, you take your chances. Will be giving it a thorough going over and test drive. If the repair costs stack up too much, I will walk away.

No - but it depends what they sell the car as - they recognised way to get around it is to sell the car as spares/repairs or for salvage/parts use only.

And in their T's and C's:

"in order to totally comply with sale of goods act 1979, we hereby stipulate, any vehicle sold on this listing, is not fit for any purpose other than for spares or repair, as are all cars sold by us including this one, and are invoiced as such"

So they have that covered I think.

'sold as seen' does not exist if you are a trader, no matter what they write on the receipt or what you sign.

Nothing is black and white, and the various shades of grey will be interpreted differently by different people....

If the car has a known fault, and this is pointed out and is signed 'as seen', then I agree the dealer is pretty much absolved of their responsibility, particularly on a cheap used car.

However, if the dealer (for example) sells you the car as having an OK engine and gearbox, and it blows up the next day.... you are covered under the Sales of Goods Act, no matter what he has had you sign the day before.

Essentially - faults pointed out by the dealer and you acknowledge as being present = not dealers responsibility. Faults not pointed out or that become apparent within 3 months = dealer responsibility, regardless of what they might try to tell you at the time of sale.
