Default Engine System Service Required

I picked up my new V50 D5 R-Design SE Sport on Saturday from an indi dealer (58 plate, 64k on the clock) and when test driving it the week before it had this error on the DIS. I was told that this would be checked out and whatever required fixing would be sorted. When I collected the car on Saturday I was told the car had had a full service (non-Volvo dealer) and the error code was no longer there. After driving for about half an hour the error came back, and its been intermittent ever since.
Out of curiosity I phoned the nearest Volvo main dealer to me, quoting the 'free health check' offer and got told that I have to pay £98 + VAT just for them to plug in their diagnostic equipment, and depending on the type of fault (if there is one, as it may be a software fault) how much I would have to pay.
Coming from an Audi where I was used to impeccable service this has already left a bitter taste in my mouth!

I have contacted the dealer I bought the car from as it came with a 3 month warranty and he said they have a guy who has all the diagnostic software and will get him to sort it out.

What should I do in this situation? I have spoken to a friend who works for a independent Volvo dealer and he said its a well known error that has been getting thrown up since one of the last updates that makes the system think there is too much oil and the car is perfectly safe to drive.
However, I dont want this other guy to just delete the error off the car without checking first if there actually is something wrong with the car.

Should I bite the bullet and spend the £98 + vat to get a proper report from Volvo?

check oil level....D5 must be kept below half
when DPF regen's it causes oil level to rise.

I've made this mistake. Once oil level is reduced warning will go off in a few days

Check the oil level, it shouldn't be more than half way between min and max.

Thanks chaps I'll have a look tonight. If there is too much oil is it simply a case of getting underneath, loosening the sump plug and draining a little off?

You won't be disappointed with the drive and quality of the car. I had always been a VAG and BMW lover but wanted somthing different and the V50 was a good size and the D5 engine bomb proof (unlike the 2.0 VAG tdi)

Oh trust me I am absolutely loving the car so far and its got some serious power under that bonnet. The engine is not as smooth as the Audi I had though, but if it lasts anywhere near as long as my brothers V40 has done I will be a happy man!

we had ours since december and now has 123k on clock (bought with 115k)

economy floats between 40 and 44mpg (worked out off tank)

we love the 5 pot growl.......and you're right it does have some shove
but is a quite lazy engine. Needs to be thrashed to get most out of it.

Then I'd say there is something wrong with your car.

The D5 should be pulling very well, smooth and hard right from low down all the way through 4000 rpm. Perhaps your needing a decoke, egr cleaned or have a weak actuator?

The engine certainly shouldn't need to be thrashed to get the best out of it, you should be getting the best out of it without thrashing.
