Default Question regarding new XC90 purchase

Hello guys

Just wanted an opinion or two.

Bought a 2017 XC90 from a garage and had an AA inspection completed, nothing major to stop me buying the car.

I took it to my local Volvo dealer for a major service just to make sure all is good and that any issues are highlighted before my 30 days consumer rights expires.

It has come back with cam belt replacement, I knew about that so happy to cover that cost.

It had an advisory on the MOT about track tie rod that again i would sort out at the next service/MOT.

But it also has a leak from the EGR pipe that you can smell in the car on start up.

The dealer has basically said, because the AA inspection didn't spot it, I should look to claim from them. I have replied its immaterial as the issue was there even if not spotted and if they had flagged it, he probably would have repaired it prior to selling the car to me. Basically he is playing hard ball, which is no real surprise post sale.

Any thoughts or suggestions?

What's the price of an EGR pipe? Can it be DIY fitted?

Then weigh up cost of getting it sorted vs the hassle of chasing selling dealer.

Volvo quoted £384 but obviously a large chunk of this will be labour.

Just not happy with the garages attitude as we are not talking about a massive bill and its just about doing the right thing.

Blaming the AA is just bizarre and he is trying to bully me away IMO.

I think you might find that the "AA inspection" is not done by AA staff but by the garage following, in theory, an AA checklist, no more and no less. Certainly this is how RAC "inspections" work.

Chase the garage. Suspect they are "at it".

There was a recall on the D5 to fit a modified EGR bracket, check your car has had the work carried out.

It was an AA inspection that I arranged through the AA and even spoke to the engineer post inspection.

But I certainly feel they are unreasonable and playing hard ball.

The garage has certain legal obligations. It is not an area of my expertise, but I think any fault which appears within 6 months of purchase is deemed to have been present at purchase and should be rectified by the seller.

You engaged the AA for your own peace of mind. Doing so does not remove or reduce your legal rights. As such the garage remains liable.

They are therefore trying it on and trying to push back on the AA is just a tactic to try and cloud what actually seems to be pretty clear cut.

Thanks Philip

You have hit the nail on the head.

Time to paste some legal rights into my next email and see what they say.

Its not worth rejecting the car at this stage, its more on point of principle.

Thanks again

Thanks all, especially Philip as a strong email, reminding the dealer of my rights as a consumer seems to have him come around as nice a pie in terms of fixing the issues.

I wonder how many other buyers he tries to pull the wool over there eyes and fob off.
