Hi all,
Volvo are saying they will pay 50% of the cost. I bought the vehicle from another dealer (down south) rather than the one it's currently with now. Just thinking about next steps as (having read up on consumer law uk) I have to prove that the vehicle is not fit for purpose. Any advice for next steps? Volvo seem to be washing their hands of it albeit offering 50% contribution - but I cannot get over the fact that it's only done 24k in just over 3 years and the engine has failed.. |

And how long have you personally had the car for and how did you pay for it?

All serviced and MOT'd. I'd have to check documents on Car and Home insurance - not sure off hand. |

Right now, I'd be looking at post 19 and getting a solicitor on the case. A stiffly worded notice before action letter might generate a decent result.

You can't jump straight to a LBA, you need to engage with the supplying dealer first and give them a chance to put it right.

I don't think that's correct. I think the section of the Consumer Rights Act (or whatever it's called now) you are relying on here is that the item was of satisfactory quality when they sold it to you. IMO, you don't have to prove anything, they have to prove the car passes the durability test (an important element of the quality issue). I don't see how any qualified person could support the notion that a £46k car bought on 4,500 miles, can do 24,000 more miles in 3 years, having been serviced in accordance with the manufacturers schedule.......and can then be reasonably expected to fail completely due to wear and tear. I would agree with the above, get some legal advice and talk to the supplying dealer - your issue is with them, not Volvo UK. Hope you get the right result. James

Perhaps enquire whether they will consider paying you the £4500 in cash to close the issue (in whatever writing they want)? Take the car to an independent engine builder and see what change you’d get from the £4500 to fix it?
