There is only one way of using that statement, pre 2000 or as a private seller which is why people dont always declare they are traders, but then there is a law covering that, we could go on forever, bottom line he knows he's doing wrong, or at least everyone else should. No warranty given or implied, by selling it as roadworthy thats warranty in itself, and warranty in legal speak does not mean a policy, its a condition or certain parts of the cars general safety, use etc.

I agree with most of the comments on this thread.

If as a Volvo specialist this car was 'decent' he would have at least have put a new MOT on the car, the fact that the MOT expires this month would put me off immediately.

Secondly, there can't be many of these with the full options list including Sat-Nav, which means if I was looking for one I'd be prepared to pay premium prices for a car in good condition.

I'm guessing it's a shed albeit on the surface a good looking shed.

All traders are now under a duty to trade fairly (Consumer Protection from Unfair Trading Regs 2008), by him saying he is a VOLVO SPECIALIST, he should be in a better position than most traders to know if anything is wrong with it. Therefore if someone buys it and it wont pass a MOT or is unsafe he should've been in a position to know and therefore should've told the buyer (Misleading Ommission, Regulation 6 of regs mentioned). If it was bought to be put on the road a buyer would be reasonably expected to want it to pass an MOT, therefore his transactional decision would've been affected had he known it would fail an MOT thereby bringing in the regulations mentioned. No need to argue with anyone other than those making the law. I'm only trying to help people out but it appears some would rather it be Caviat Emptor!

Do you think they dont know the law?.
Whatever it sell for it will all be profit.

Yes, it didn't sound too good; rather neglected...and the fact that he's a specialist and won't be drawn on the car's condition is a little iffy.

I have potentially bought another one, at Select Marques in Yorkshire (or I have paid a deposit and will be inspecting it on SUnday). Saffron V70R AWD. Anyone know anything about it? R935 XWR, 153k miles, 1997 V70R AWD in Saffron...

MOT only indicates that on the day presented to the test station the car had no defects that would affect the overall day to day running of the car, and as i'm sure you and most people in the country are aware, some garages are less than thorough. Just because a car has an MOT does not mean its in good shape. How many people have bought a car with an MOT only to have it break in some way shape or form. Mine has six months MOT left on it, and in those last six months the track rod end has failed, i've just had to replace the front discs and pads, the full exhaust from CAT back, two wheels have been bent in a pot hole. Need i go on???

As previously mentioned traders are under a duty to trade fairly because they know more about the servoce/goods they are providing. Some traders do not know this, some choose to ignore it, its the way of the world unfortunately. Its why people in law enforcement have jobs.
