Default Bought a car and it’s a Lemon,small claims court an option?

Bought a V70 D5 and after purchasing it it’s turned out to be shagged.
Oil leaks and many faults.
I just need to know how to get money back
I got an independent mobile mechanic to come out and he’s photographed and recorded all the faults.
Seller won’t answer phone or texts
Small claims a court an option?

Your rights will depend on who you bought the car from (private or dealer), how it was described and how much you paid for it.
If private then you are on your own unless they made specific representations about the condition. If dealer then you should contact them (in writing if they are not answering the phone) to ask them to remedy the faults or refund you.
You also need to bear in mind that you could spend money making the on line claim, win it and then still have to spend more money and time to get the seller to pay - and if they don't have assets then you still may not get your money.

If Trader, and if recent, exercise your Right to Reject the car for a full refund.

Thanks for advice so far.
It was from a trader on ebay 266476493697
Would be good to name and shame him so I’m thinking of putting it back on eBay with the pictures of all the faults and the guys contact details,at least to stop him from ripping others off.

Contact eBay. Explain situation. Ask for them to intervene. Don't get fighty like you are suggesting above - at least until you've got it resolved...

This is from the mechanic who looked at it.

Honestly if you can get your money back il go down that route

There not gonna want the repair costs as it’s gonna be
Expensive to fix everything also we have to understand that vehicle has covered some good milage at 175k

So the servo pump leaking slightly is acceptable but defective

The engine in my opinion sound noisy at 2000rpm (tappy)

There isn’t a continuous leak (drip-drip) of oil at time of inspection but has an obvious Oil Leak front main crank shaft oil seal. there’s oil in the lower timing cover and external of cover/ lower part of engine recommended repair
Sump gaskets and front main oil seal
I’d recommend replacing timing belt along with carrying out this repair cambelt replacement (the parts) would be at your cost unless you’ve been told it’s been done


Rocker cover gasket/ inlet manifold gasket has an oil leak recommend doing this repair as it’s leaking down front of engine the inlet manifold runner control solenoid has a broken arm leading to inlet manifold.
the runner flaps in the inlet manifold are obviously defective and there flopping about.


Multiple defects found in system scan see pictures

3 litres of oil added to engine prior to inspection
