Interesting that a second buyer has rejected it and now this third time they have listed it under a different e-bay username.....

Given the trader's claim to be selling for parts only and your option to reject on the day of inspection only, how did you get him to take it back?

Spoke to them on the phone, I politely told them I was rejecting the car due to headgasket issue and after a few further calls, they agreed.

Like I mentioned earlier in the thread - nothing written by the seller in the T&Cs excuses them from their statutory obligations as a car trader...

In fairness, it seems like they know that despite what they might try and get impressionable or uninformed people to believe.

The goods (unless being sold for significantly under market value) need to be of merchantable quality at the time of sale.

It sold on ebay again, this time for £2.9k. Wonder if it will be back up for sale shortly!?!

....unless the car is sold for "spares or repair" in which case the whole and sole onus is on the buyer to ensure the vehicle is roadworthy before driving it. However they should back that up with a stipulation that the car should be collected on a trailer/recovery truck and not encourage people to test drive them without tax or potentially insurance, otherwise they are contradicting themselves by their actions.

What could be an offence would be to mis-describe the car - e.g. say it is spares or repairs due to age/mileage and not mention other faults that were known to you (e.g. failed brakes, bald tyres). "Sold as Seen" is not a recognised get out for traders when selling cars, it has to be made clear to the buyer that what they are buying is for spare parts, salvage, or needing repairs. This does not necessarily mean unroadworthy, a car could have failed aircon, stereo, noisy gearbox but still be roadworthy.

Interestingly the seller currently has no cars listed.

Haven't been on here for such a long time.

Thought I'd have a perusal of ebay as you do and to my astonishment the XC90 is still alive

The car seems to have lost around 20,000 miles around 2008.

That one's been on eBay for a couple of months now - I had a look at the listing when I was looking but the mileage and distance from home didn't make me enquire any further.

Happy with what I got though, another manual SE with 115k on the clock and FSH for not much more. Apart from the spline sleeve issue that the dealer has covered, I'm well happy with it.

That Scarab Green pearl colour in the ad is really nice in the sun, although the Cedar Green of mine does take on a similar 2 tone look all be it a bit understated.
