Default Drive shaft problems after 5 days of ownership!!!

So i decided to splash out on a brand new XC90 Active!!!

Absolutely chuffed to bits with it until my fifth day of ownership when it decided to lose all power coming out of an NCP car park!!!

The prompt response of volvo roadside assistance came to my aid after 5 hours of waiting to take me back to my dealer.

The news came back today that it was a fault on the drive shaft and a new part would be required that may not arrive until after christmas!!!

So here i am after buying a new car to get me through the winter period and next snow storm only to find myself in a Suzuki Swift...how does that work??

So i wondered if anyone else has had a problem with the drive shaft and losing all power and also any recommendations on how i should deal with Volvo as lets face it a car breaking down with 250 miles on the clock is an absolute joke!!!!

I would be more worried about the Suzuki Swift. Is this your own vehicle, or a loan car? I would insist on an equivalent loan car, even if second hand older version of the XC. I bought the XC for safety reasons predominantly, and so wouldn't accept the dealer compromising that feature.

The fact it's broken down 5 days in is bad, very bad, but OK **** happens, 5 hours for recovery is also unacceptable, part not available until after xmas, hmm, getting worse but survivable....not having a comparable replacement car is bang out of order and a Suzuki Swift......don't Suzuki make motorbikes!!

Someone is seriously taking the mick! Landrover Assist use Enterprise for replacement cars and it's always another LR vehicle, I've had Freelanders and Full fat Range Rovers......there's a reason you buy and XC90 be it the 7 seats/4x4 capability etc.

Tell the dealer you are going away at xmas, 7 people plus luggage and enquire as to how you are supposed to do that in a Swift? I'd start making mumblings of rejecting the car, canceling finance agreements etc unless they sort something out.

Strongly worded letter from solicitor ? "merchantabe quality" "fit for the purpose" etc?
get the supplying dealer to supply a Loan car of equal or higher spec while they fix yours,
take it direct to volvo uk if local dealer fobbs you off with an unacceptable answer.

Why / how did you end up with the suzki swift ? if thats there "loan car" ,,,something needs seeing to @ said dealer,,

what a crap dealer, if we ever had any problems with new cars and couldnt give the customer like for like from stock even if secondhand we rented the equivelent vehicle for the customer while the problem was sorted.

As has been said before start mentioning about not wanting that car back, u can actually refuse to take it back and demand a new car as u think its what they call "friday afternoon, monday morning car" ie: is this the first of a series of troubles to come?

You would be clearly within your consumer rights to reject the car straight away after such a short time, that call is yours but make your decision quickly as time is of the essence here with the consumer laws.

If you do reject the car, do so in writing stating clearly the reason for rejection and deliver it to the manager by hand, there is no need for the assistance of a solicitor as this is a very basic consumer right under the sale of goods act.

Personally I would reject it as you will have a brand new repaired car which was subject to quite a serious sounding fault, you need to ask yourself would you be happy afterwards, however if you accept a repair your right to rejection will be less.

I hope you get sorted and sorry to hear of your problem

I'd let them have a go on it (just one go) but I'd expect an XC90 courtesy car at the least. The whole situation is no acceptable.

If no luck then reject - you'll find they will suddenly move heaven and earth for you.

That's pathetic! Tell them what's what!!! Then take action if they don't. Really bad start, hope it's just a one-off for the car.

Could be a dual brand dealer....the dealer supplying mine (who I already know I won't be using for servicing/repair) do Volvo, Lotus an Fiat.....wonder which brand there courtesy cars are!!
